Welcome to BarrelIQ. These Terms of Service ("Terms") govern your access to and use of the BarrelIQ application, website located at barreliq.app, and all related services, features, and content (collectively, the "Service"), operated by BarrelIQ ("BarrelIQ," "we," "us," or "our").

By accessing or using the Service in any way — including browsing the website, creating an account, or purchasing a subscription — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately discontinue use of the Service. We reserve the right to update or modify these Terms at any time. Continued use of the Service following any changes constitutes your acceptance of the revised Terms.

You must be at least 18 years of age to access or use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into a binding agreement;
• Your use of the Service does not violate any applicable law, regulation, or ordinance in your jurisdiction;
• You are not located in a jurisdiction where accessing sports analytics services is prohibited;
• You will use the Service solely for lawful, personal, and non-commercial purposes unless otherwise expressly authorized in writing by BarrelIQ.

BarrelIQ reserves the right to refuse access to the Service to any person or entity at its sole discretion, including where eligibility requirements are not met.

BarrelIQ is a professional baseball analytics platform that provides subscribers with data-driven insights, predictive models, and statistical research tools designed to enhance understanding of MLB player performance and game conditions. The Service includes:

• Daily AI-generated home run rankings and HR Scores;
• Multi-layer predictive models evaluating batter-pitcher matchups;
• Batter power metrics including barrel rate, exit velocity, and hard-hit percentage;
• Pitcher vulnerability analysis and bullpen threat assessments;
• Park factor analysis across all 30 MLB ballparks;
• Real-time weather and wind condition modeling for outdoor venues;
• Collision match scoring based on platoon splits and historical head-to-head data;
• Confidence tier classifications (Elite, High, Moderate, Speculative);
• Statistical projections and matchup research tools.

BarrelIQ does NOT:

• Guarantee any specific outcome, result, or performance by any player or team;
• Guarantee profits, returns, or financial gains of any kind;
• Provide financial, investment, or gambling advice;
• Operate as a sportsbook, betting exchange, or gambling platform;
• Accept wagers, bets, or any form of monetary stake on sporting events;
• Provide licensed gambling services in any jurisdiction.

All content, scores, rankings, and projections provided by BarrelIQ are for informational and entertainment purposes only. Nothing in the Service constitutes a recommendation to place any wager or make any financial decision.

BarrelIQ is an analytics and research platform. All data, scores, rankings, projections, visualizations, and other content provided through the Service are strictly informational in nature and are not intended to constitute, and should not be construed as, gambling advice, betting tips, or recommendations to place any wager.

Sports betting involves substantial financial risk. Past analytical performance does not guarantee future results. No predictive model — regardless of its sophistication — can reliably predict the outcome of any individual sporting event.

By using the Service, you expressly acknowledge and agree that you assume all risk associated with any betting, wagering, or gambling decisions you make, and that BarrelIQ bears no responsibility or liability for any losses, financial or otherwise, arising from such decisions.

To access certain features of the Service, including Premium subscription content, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information;
• Maintain and promptly update your account information to keep it accurate;
• Maintain the confidentiality of your account credentials and accept responsibility for all activity that occurs under your account;
• Notify BarrelIQ immediately of any unauthorized use of your account;
• Not share your account credentials with any third party;
• Not create more than one account per individual without express written permission.

BarrelIQ is not liable for any loss or damage arising from your failure to maintain the security of your account credentials. You are solely responsible for all activity conducted through your account, whether or not authorized by you.

BarrelIQ offers paid subscription plans that provide access to Premium features of the Service. By purchasing a subscription, you agree to the following terms:

Recurring Billing. Subscriptions are billed on a recurring basis — either monthly or annually, depending on the plan selected. Your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date.

Cancellation. You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features through the end of the paid period. No partial refunds are issued for unused time within a billing period unless required by applicable law.

App Store Purchases. If you purchase a subscription through the Apple App Store, your subscription is managed by Apple and subject to Apple's terms and conditions. Billing, renewal, and cancellation for App Store purchases are handled exclusively through your Apple ID account settings. BarrelIQ does not have access to App Store billing information and cannot process refunds for App Store transactions. Please contact Apple Support for billing inquiries related to App Store purchases.

Price Changes. BarrelIQ reserves the right to modify subscription pricing at any time. We will provide reasonable advance notice of any price changes. Your continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

Taxes. Subscription prices are exclusive of applicable taxes. You are responsible for all taxes, duties, and similar charges applicable to your purchase.

All content, features, and functionality of the Service — including but not limited to BarrelIQ Scores, home run rankings, predictive models, algorithms, statistical databases, analytical frameworks, software, source code, application architecture, visualizations, graphics, user interface design, trademarks, service marks, logos, trade dress, and all related intellectual property — are the exclusive proprietary property of BarrelIQ and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial use in accordance with these Terms. This license does not include any right to:

• Scrape, crawl, spider, or otherwise systematically extract data, content, or information from the Service using automated tools or manual processes;
• Copy, reproduce, duplicate, or create derivative works based on any portion of the Service or its content;
• Redistribute, sell, resell, sublicense, or otherwise transfer access to the Service or any content derived from it;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying methodology of any part of the Service;
• Use BarrelIQ data, scores, rankings, or analytical output for commercial resale, publication, or distribution without express written authorization;
• Build, develop, or operate any competing product, service, or platform using data, models, methodologies, or intellectual property derived from or inspired by BarrelIQ.

Any unauthorized use of BarrelIQ's intellectual property is a material breach of these Terms and may result in immediate account termination, legal action, and claims for damages.

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You agree that you will not:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation;
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, or any systems or networks connected to the Service;
• Introduce viruses, malware, ransomware, or any other harmful or disruptive code into the Service;
• Use the Service to transmit unsolicited communications, spam, or any form of commercial solicitation;
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity;
• Interfere with or disrupt the integrity, performance, or availability of the Service or its underlying infrastructure;
• Use the Service to collect or harvest personal information about other users without their consent;
• Circumvent, disable, or otherwise interfere with security-related features of the Service, including features that prevent or restrict use or copying of content;
• Share your account credentials or allow any third party to access the Service through your account;
• Use the Service in any manner that could damage, disable, overburden, or impair BarrelIQ's servers or networks.

BarrelIQ reserves the right to investigate and take appropriate legal action against anyone who, in BarrelIQ's sole discretion, violates this provision, including reporting such violations to law enforcement authorities.

BarrelIQ sources baseball statistics, player data, lineup information, park data, and weather conditions from third-party data providers and publicly available sources. While we make reasonable efforts to ensure the accuracy and timeliness of the data presented through the Service, we cannot guarantee that all information is complete, accurate, or current at all times.

You acknowledge and agree that:

• Baseball data is inherently subject to real-time changes, including last-minute lineup substitutions, injury scratches, pitching changes, and weather-related game postponements;
• Occasional inaccuracies, data delays, scoring corrections, or retroactive statistical adjustments may occur and are beyond BarrelIQ's control;
• Predictive models and analytical scores are based on historical data and statistical probabilities, and do not account for all variables that may affect game outcomes;
• BarrelIQ is not responsible for any decisions made in reliance on data that is subsequently found to be inaccurate, incomplete, or outdated.

We encourage users to verify lineup and game-day information through official MLB sources before making any decisions based on BarrelIQ analytics.

BarrelIQ strives to maintain high availability of the Service, but we do not guarantee uninterrupted, error-free, or continuous access. The Service may be temporarily unavailable due to:

• Scheduled maintenance, updates, or infrastructure improvements;
• Unplanned outages, technical failures, or third-party service disruptions;
• Events beyond our reasonable control, including natural disasters, power failures, or internet service disruptions;
• Security incidents or emergency remediation efforts.

BarrelIQ reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you. We will make reasonable efforts to provide advance notice of planned maintenance or significant service changes.

Temporary unavailability of the Service does not entitle you to a refund or credit unless otherwise required by applicable law or expressly stated in a separate service level agreement.

The Service may integrate with, link to, or rely upon third-party services, platforms, and data providers, including but not limited to payment processors, analytics providers, cloud infrastructure services, and baseball data vendors. These third-party services are governed by their own terms of service and privacy policies, which are independent of BarrelIQ.

BarrelIQ does not endorse, control, or assume responsibility for the content, accuracy, availability, or practices of any third-party service. Your use of third-party services is at your own risk and subject to the applicable third-party terms.

Payment processing for web subscriptions is handled by Stripe, Inc. By purchasing a subscription through the BarrelIQ website, you agree to Stripe's terms of service and privacy policy. BarrelIQ does not store your full payment card information on its servers.

The Service may contain links to external websites or resources. BarrelIQ is not responsible for the content, accuracy, or availability of such external sites and does not endorse any products or services advertised or offered on third-party websites.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BARRELIQ EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY DATA, SCORES, RANKINGS, PROJECTIONS, OR OTHER CONTENT PROVIDED THROUGH THE SERVICE;
• WARRANTIES THAT ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM BARRELIQ OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BARRELIQ, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

WITHOUT LIMITING THE FOREGOING, BARRELIQ IS SPECIFICALLY NOT LIABLE FOR:

• Any betting losses, gambling losses, or financial losses of any kind arising from decisions made in reliance on BarrelIQ analytics, scores, rankings, or projections;
• Lost profits, revenue, data, or business opportunities;
• Indirect, incidental, consequential, or punitive damages, even if BarrelIQ has been advised of the possibility of such damages;
• Damages resulting from unauthorized access to or alteration of your transmissions or data;
• Damages resulting from any interruption, suspension, or termination of the Service;
• Damages resulting from inaccurate, incomplete, or outdated data provided through the Service.

IN NO EVENT SHALL BARRELIQ'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO BARRELIQ DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY.

You agree to defend, indemnify, and hold harmless BarrelIQ and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms;
• Your use or misuse of the Service;
• Your violation of any applicable law, regulation, or third-party right;
• Any content you submit, post, or transmit through the Service;
• Any claim that your use of the Service caused damage to a third party.

BarrelIQ reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, in which case you agree to cooperate with BarrelIQ in asserting any available defenses.

BarrelIQ reserves the right, in its sole discretion, to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or any applicable law;
• Fraudulent, abusive, or harmful conduct;
• Unauthorized scraping, data extraction, or intellectual property infringement;
• Non-payment of subscription fees;
• Any conduct that BarrelIQ determines, in its sole discretion, to be harmful to the Service, other users, or BarrelIQ's business interests.

Upon termination, your right to access and use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination — including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations — shall survive termination.

You may terminate your account at any time by contacting us at [email protected]. Termination of your account does not entitle you to a refund of any prepaid subscription fees, except as required by applicable law.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, store, and share information about you when you use the Service.

Please review our Privacy Policy carefully at barreliq.app/privacy. By using the Service, you consent to the data practices described in the Privacy Policy.

BarrelIQ reserves the right to modify, update, or replace these Terms at any time at its sole discretion. When we make material changes to these Terms, we will update the "Effective Date" at the top of this page and, where appropriate, notify you via email or a prominent notice within the Service.

Your continued access to or use of the Service after any changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Service and, if applicable, cancel your subscription before the changes take effect.

These Terms and any dispute or claim arising out of or relating to these Terms, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the State of New York, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

Notwithstanding the foregoing, BarrelIQ may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or prevent irreparable harm.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect.

The failure of BarrelIQ to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any provision of these Terms will be effective only if it is in writing and signed by an authorized representative of BarrelIQ.
